1. Introductory provisions

1.1 These Terms and Conditions of Business (hereinafter referred to as "Terms and Conditions") of the company Karlovarská sůl s.r.o., with registered office at Na Výhledě 1076/3C, Stará Role, 360 17 Karlovy Vary, identification number: 11669403, registered in the Commercial Register maintained by the Regional Court in Pilsen, Section C, Insert 41003 (hereinafter referred to as "Seller"), regulate in accordance with the provisions of Section 1751(1) of Act No. 89/2012 Coll, Civil Code, the mutual rights and obligations of the parties arising from a purchase contract (hereinafter referred to as the "Purchase Contract") concluded between the Seller and another natural person (hereinafter referred to as the "Buyer") through the Seller's online shop. The online shop is operated on the website www.carlsbad-salt.com.

1.2 These terms and conditions do not apply where the person purchasing the goods from the Seller is acting in the course of their business or profession.

1.3 Any deviating provisions in the Purchase Agreement shall prevail over the Terms and Conditions.

1.4 The Terms and Conditions are an integral part of the Purchase Contract. The Purchase Contract and the Terms and Conditions are drawn up in the Czech language.

1.5 The Seller may change or supplement the wording of the Terms and Conditions. This does not affect the rights and obligations arising under the previous version of the Terms and Conditions.

2. User account

2.1 Upon registration of the Buyer on the Website, the Buyer can access his/her user interface. From there, the Buyer can order goods. Ordering can also be done without registration.

2.2 The Buyer is obliged to provide correct and truthful information, which must be updated in the event of a change.

2.3 Access to the user account is protected by a username and password, which the buyer may not share with third parties.

2.4 The Seller may cancel the user account if the Buyer does not use it for more than 2 years or violates his obligations under the Purchase Agreement.

2.5 The Buyer acknowledges that the User Account may not be available around the clock for maintenance.

3. Conclusion of the purchase contract

3.1 The presentation of goods on the web interface of the shop is informative and does not constitute an offer to conclude a contract.

3.2 The web interface contains information about the goods, prices, packaging and delivery costs, including, where applicable, the offer of free shipping, which applies to orders that meet a minimum value.

3.3 An order for goods is placed via an electronic form on the website. The buyer has the opportunity to check and change the details before submitting the order.

3.4 The Seller is entitled to request additional order confirmation.

3.5 The contractual relationship arises upon delivery of the acceptance of the order by the Seller to the Buyer's electronic address.

3.6 The Buyer shall bear the costs incurred when using remote means of communication.

4. Price of goods and payment terms

4.1 The price of the goods and any delivery costs can be paid in the following ways:

• in cash at the seller's address
• cash on delivery
• by wire transfer to the seller's account
• by credit card
• on personal collection

4.2 Prices remain valid for as long as they are displayed on the web interface of the shop.

4.3 Non-cash payments are due within 7 days of the conclusion of the purchase contract.

5. Withdrawal from the Purchase Agreement

5.3 To withdraw from the Purchase Agreement, the Buyer may use the sample form provided by the Seller. The withdrawal from the purchase contract must be sent to the Seller's business address or to the electronic address info@carlsbad-salt.com.

5.4 In the event of withdrawal from the purchase contract, the Seller shall refund the purchase price without undue delay, no later than 14 days after receipt of the returned goods or proof that the goods have been sent back.

5.5 The Seller reserves the right to set off claims for compensation for damage to the goods against the Buyer's claim for reimbursement of the purchase price.

6. Transport and delivery of goods

6.1 The method of transport of the goods is determined on the basis of the buyer's requirements. In the case of a special method of transport chosen by the buyer, the buyer shall bear any additional costs associated with this transport.

6.2 The Buyer is obliged to take delivery of the goods upon delivery to the address specified in the order.

6.3 If the goods are not accepted on delivery, the Seller shall be entitled to claim the cost of redelivery.

6.4 Upon receipt of the goods from the carrier, the buyer is obliged to check the packaging of the shipment. In the event of damage to the packaging or the shipment, it is necessary to inform the carrier and, if necessary, not to accept the shipment.

7. Rights from defective performance

7.1 The rights and obligations of the contracting parties with regard to rights arising from defective performance shall be governed by the applicable legal provisions, in particular Sections 1914 to 1925 and Sections 2099 to 2117 of the Civil Code.

7.2 The Seller shall be liable to the Buyer that the goods are free from defects upon receipt and correspond to the agreed description, quality and characteristics.

7.3 In case of defective performance, the buyer has the right to repair, delivery of a new item, a reasonable discount or withdrawal from the contract, depending on the nature of the defect.

7.4 The Buyer is obliged to file a claim with the Seller without undue delay after discovering the defect.

8. Other rights and obligations of the parties

8.1 The buyer acquires ownership of the goods by paying the full purchase price.

8.2 Consumer complaints are handled by the Seller via electronic mail at info@carlsbad-salt.com.

8.3 The Buyer may contact the Czech Trade Inspection Authority or the European Consumer Centre Czech Republic in the case of out-of-court dispute resolution.

9. Privacy Policy

9.1 The Seller complies with the information obligation towards the Buyers in accordance with Article 13 of the GDPR Regulation and processes the Buyer's personal data for the purposes of the performance of the Purchase Agreement, the negotiation of the Purchase Agreement and the fulfilment of legal obligations.

10. Sending commercial communications and storing cookies

10.1 The Buyer consents to the Seller sending commercial communications to the Buyer's electronic address or telephone number.

10.2 The Seller complies with the legal obligations regarding the storage of cookies in accordance with the relevant legislation.

11. Delivery

11.1 The Buyer may be delivered to the Buyer's electronic address specified in the user account or order.

12. Final provisions

12.1 The legal relationship between the Seller and the Buyer is governed by Czech law.

12.2 If any provision of the Terms and Conditions is invalid or ineffective, its invalidity shall not affect the other provisions.

12.3 The Purchase Contract and the Terms and Conditions are archived by the Seller in electronic form and are not accessible.
